Storage Wars – The Law Governing Self Storage Facilities

The Lien Law & Storage Facilities

The Self-Service Storage Facilities Act in Pennsylvania regulates these facilities. Notably, the Law states that the storage facility owner has the right to take over all personal items held in the storage facility. This lien covers all apart from the ones that existed before placing the specific personal property inside the facility. The rentals contract needs to notify the renter of the lien.

If the resident does not pay rent within 30 days, the storage facility owner can initiate the process of selling the content. The owner has to inform the storage unit renter of their default in payment. The notice has to be delivered according to the law and must contain things like the total amount payable, monthly payment requirements, specific persons they can get in touch with, and that the items in the storage will be advertised and sold unless delinquent payment has been settled. Also, the owner has the right not to allow the renter to enter the facility until the breach is paid out.

If the storage renter still cannot pay, the facility owner can go on to advertise the contents for sale. The owner needs to advertise on local publications twice. Advertising content has different requirements. In addition, sales must take place at a minimum of 10 days following the initial ads.

If the arrears are not paid, the owner is at the liberty to sell the items in the warehouse to pay the owner’s lien. Third parties may put money on it and the best bidder can buy all the contents of the unit.
